      RULING REQUEST AFTER LIVERPOOL SALE
      Bank bosses involved in a sale of Liverpool Football Club have asked a High Court judge to declare them not guilty of "any dishonesty or corruption".

      Lawyers representing the Royal Bank of Scotland (RBS) told Mr Justice Peter Smith that former Liverpool owners Thomas Hicks and George Gillett had alleged a "grand conspiracy" but failed to produce "any evidence".

      The bank's call for declarations of innocence - at a High Court hearing in London - marked the start of the latest round of civil litigation in the wake of the 2010 sale.

      Hicks and Gillett launched legal action claiming that the club was sold at a "substantial undervalue" and said the RBS and Liverpool directors "deliberately" blocked their attempts to "refinance".

      RBS bosses and directors dispute the allegations.

      Richard Snowden QC, for the RBS, on Tuesday asked the judge to rule that there was no case to answer - and directors are expected to make a similar application if the bank succeeds.

      "In short, RBS contends that it is entitled to declarations to the effect that RBS was not a party to any dishonesty or conspiracy in relation to the sale in October 2010 of Liverpool Football Club," said Mr Snowden, in written submissions given to Mr Justice Peter Smith.

      "Messrs Hicks and Gillett (alleged) a 'grand conspiracy' involving RBS. More than a year later and despite an extensive review of documents they have signally failed to produce any evidence to support these allegations."

      Hicks and Gillett say a trial is needed and complain that granting the RBS "the legal equivalent of a 'Get Out of Jail Free card"' would "stand justice on its head".

      The hearing is expected to end later this week and the judge is then likely to reserve judgment to a later date.

      Hicks and Gillett allege that the RBS unfairly "took control away" from them when it "enforced its rights to repayment against a borrower".

      Their lawyers allege that the RBS brief to directors appeared to have been to "secure the sale of the assets as quickly as possible".

      "Refinance was available and RBS could have been repaid in full," said Ali Malek QC, for Hicks and Gillett, in written arguments given to the judge.

      "They were however so fixed on their objective of severing all links between the club and the former owners that a commercial approach was not followed."

      He said Hicks and Gillett had a "powerful case" and told the judge that there was a "need for a trial".

      Malek added: "To grant at this stage... the legal equivalent of a 'Get Out of Jail Free card' would be to stand justice on its head."

      Liverpool was sold to New England Sports Ventures - headed by American businessman John W Henry - in a ÂŁ300million deal on October 15 2010.

      Hicks and Gillett, who are also American, tried and failed to block the sale after launching legal action in the High Court.

      They also launched then halted legal action in the United States, claiming an "epic swindle".

      Both subsequently launched damages claims against RBS and Liverpool directors Sir Martin Broughton, Christian Purslow and Ian Ayre.

      The basta*ds should be made to pay for the damage they caused to Liverpool Football Club and our tradition They so very nearly got away with bankrupting us but lucky they were caught just in time.I hate to think what would of happened if they had been our owners for another 12 months.

      they are still seeking to damage clubs? they should buy chelsea. maybe swap roman for whatever they're F***ing with at the moment. although a quick google says they don't have their fat sweaty fingers in too many pies these days, which is of course fantastic. there is a section at the bottom of hicks' wikipedia - "philanthropy". these cu*ts are going to put on a happy face for the next few years and give money to try and buy support. good luck to them, they'll need it.

      LIVERPOOL FC's two former American owners Tom Hicks and George Gillett could be granted a lifeline in their multi-million pound bid to sue those connected with the club’s sale to Fenway Sports Group.
       
      Telling hints were today dropped by Mr Justice Peter Smith that he was leaning towards ordering the Royal Bank of Scotland to fully disclose all their documents to Tom Hicks and George Gillett in their pursuit of damages for the “epic swindle” when they lost control of LFC.
       
      RBS is at the Royal Court of Justices for a three day hearing demanding the Americans drop their litigation, citing the “inordinate amount of time” already elapsed since they outlined allegations of “ conspiracy and dishonesty” against the bank and directors Martin Broughton, Christian Purslow and Ian Ayre – accusations wholly denied.
       
      Despite Clyde and Co, representing Hicks, obtaining two boxes and 100 lever arch files of material relating to the sale of Liverpool FC – and the failed attempts to refinance the £237m of debt owed by the Americans to the bank – the solicitors are seeking more.
       
      Today Mr Justice Smith indicated he was weighted towards ordering “full” disclosure upon RBS and then imposing a strict and short period for Hicks and Gillett to examine any new evidence to decide how to proceed with their battle for damages.
       
      He said: “It seems to me that the way to consider it would be to run declarations, order disclosure and give them (Hicks and Gillett) a short leash to put up or shut up.
       
      “It’s not what your client (RBS) wants but if there’s nothing in that disclosure they have nothing to fear. If there is, it might explain why they have gone down this way.”
       
      Mr Smith also questioned why Hicks had made serious accusations of impropriety against RBS and the English directors in Texas which he has subsequently never repeated in English legal proceedings.
      Mr Justice Smith said: “I get silence from him (Hicks). I have no explanation why he doesn’t produce witness statements saying ‘I’m a victim of a massive fraud perpetrated by the English directors’ – why doesn't he do that?"
       
      “What is striking is your client is prepared to make these allegations in America yet in this jurisdiction he is unwilling to do it.”
       
      In an eye-opening confession, Ali Malek QC, for Hicks, admitted the legal suit obtained in Dallas – which prompted panic among Liverpool FC supporters worldwide as it effectively barred any sale to New England Sports Ventures (NESV) until the High Court in London overturned it – was a blunder.
       
      Mr Malek said: “What happened in Texas was undoubtedly wrong. I cant begin to defend it.
       

      “But the essence of his complaint in Texas is the same here – the bank should have accepted the offer from Mill Financial and the club was sold at an undervalue.”
       
      Mr Justice Smith also challenged Mr Malek why his client had not applied for full document disclosure from RBS if he had full confidence in his litigation claim.
       
      Mr Malek replied: “We never considered it. Maybe it was a mistake. We didn't think it was appropriate in this case.”
       
      It has also emerged RBS is still owed ÂŁ29m from Hicks and Gillett which they are still pursuing, but the former owners say no formal claim for that debt has been made to them.

      H&G have been told to "put up or shut up" by a High Court judge and their legal "shadow boxing" must end.
      They still duck and dive 3,500 miles away in Texas and issue statements of a vague legal nature about the state owned RBS and Liverpool Football Cub plc.
      Their business conduct was declared illegal in a British court of law while in Texas they seem unable to spell 'litigation' much less apply any measure of ethical business conduct. Mr Toad and Ratty took full advantage of the disparity and built up a bullshit case that was despatched in HM Court of Law unceremoniously, whereupon they retired to their lair to sulk and concoct more grandiose bullshit litigation tales.
      There is no substance whatever in their claims and as has been said if they were repeated in the UK they would be open to charges of slander and libel and subject to the full rigours of the law.

      Bellends of the highest order.

      Whilst I'd agree with everyone that ultimately Statler and Waldorf deserve f*** all and will get f*** all it's a distraction and a possible monetary drain that the club doesn't need right now as it persues more important things like bringing success back on the pitch and sorting out the issue of a stadium.
      You'd hope, as has been stated that when they file the papers they are told they simply don't have a case and that the courts time will not be wasted hearing it.   
      Of course if the matter escalated it might or might not be a concern to the club, all the bellends are doing now is banging a drum in Texas and while it might be a good title for a pantomime, their claims do not stack up in a RECOGNISED court of law.

           RBS 'Did Not Want LFC In Administration'


                       The Royal Bank Of Scotland was actively striving not to push LFC into administration and land the club
                       with a possible nine point deduction which would have ensued had they called in their ÂŁ237m debt,
                       it was confirmed yesterday.
                       While recalling their funding was an option, the bank explained how it's keeness to keep the Reds solvent
                       led to a deal with H&G giving  it their full support to reconstitute the board. It meant bringing in Sir Martin
                       Broughton, whose presence and legal agreement with the Americans meant they could not frustrate a sale
                       leaving them always in danger of being out voted three to two.
                       This week RBS is seeking a summary judgement that the American's claim for damages has no foundation
                       and is well expired.
                       That case runs alongside a similar legal request from Sir Martin who has now left Anfield, to halt H&G's action.
                       The dispute takes in the various inter-connected companies once related to LFC including Kop Football
                       (CaymenLtd), Kop Football (holdings) and Kop Football Ltd,   
                         
                       

      H&G haven't got a pot to piss in.

      Liverpool: Update From Hicks & Gillett Legal Case

      Former owners Tom Hicks and George Gillett have been given more time to build their legal challenge over the circumstances surrounding the sale of Liverpool FC to the Fenway Sports Group (formally New England Sports Ventures) 16 months ago.

      The ongoing court case has been playing out at the Royal Court of Justice this week as Hicks & Gillett continue to allege the club was sold against their will and significantly below market value. A new hearing date for their action against the Royal Bank of Scotland and then Liverpool chairman Sir Martin Broughton and his fellow English directors (Christian Purslow and Ian Ayre), has been scheduled for May after Lord Justice Peter Smith ordered the parties accused to disclose further information.

      However Mr Justice Smith warned barrister Ali Malek QC acting on behalf of Hicks: "This is his last chance. If no allegations are forthcoming, the defendant will be debarred from making allegations against the claimants [the Royal Bank of Scotland, the English directors formerly on Liverpool`s board and current managing director Ian Ayre] in the future.
       
      "This is the open door but it is going to be clanging shut. He can shout as loud as he wants in Texas but here he will be debarred."
       
      Disclosure of the additional documents will happen over the next 35 days but given confidentiality rules the pair will likely have to come to the UK to inspect the files first hand.

      Hicks and Gillett clearly hope the new material will evidence their case that they were illegally prevented from refinancing Liverpool in the run-up to the 15th October 2010 deadline for repaying the bank its ÂŁ237m debt.

      Hicks has subsequently claimed he had 10 bidders looking to invest in the club before RBS and his fellow board members conspired against the Texan and his co-owner Gillett and sold to NESV.
       
      Mr Hicks`s legal team, Clyde and Co, claimed: "The English directors` brief from RBS appears to have been to secure the sale of the assets as quickly as possible.

      "The English directors and RBS deliberately blocked the former owners from obtaining a refinance.

      "Refinance was available and RBS could have been repaid in full, but did not want that to happen.

      "They were so fixed on their objective of severing all links between the club and the former owners that a commercial approach was not followed."

      If for some crazy reason Hicks & Gillette are successful in their claim where do FSG stand and would it mean a re-sale of the club and a possible return of the previous regime at the club?

      Wonder if purslow would give evidence in support of his previous owners to back their claim that they were "Epically Swindled" ? & i wonder who these 10 bidders were.

      Feel uneasy about this.  ???

      Did you see when Mr Toad was evicted from Toad Hall if I'm not mistaken by the the bailiffs Stoat & Weasle Ltd and ended up in jail for bullshitting yet again?
      He was warned previously by the riverbank authorities that any repeat of his bullshitting activities would land him in very hot water, he couldn't help himself and was locked up. There is a striking similarity with the statements made yesterday by those in a superior position of law and H&G acting the goat.

      Have to admit I did have reservations when Martin Brouton was initially appointed and suspicions were aroused when a boardroom was established with the inclusion of the thieving Americans.
      Any concern however was misplaced and doubts about Broughton's business acumen were dispelled when it became apparent that the object of the maneuvering was to place H&G in an untenable position on that board and undermine their hold on the club.
      Not only that but Broughton sought out every escape clause and escape route before springing the snare.
      All of those bolt holes are still secured and the fraudsters choose to make threats(??) from far away Texas, invoking a response from the British legal system of 'if you think you're hard enough have a go' or words to that effect.

      They've got two chances: a dogs chance and no F***ing chance.
