      Debt Camel - Advice about Payday Loan companies irresponsibly lending.

      Just thought I'd share this information as it may to be of some help to some forum members.

      A few years ago I stupidly got myself into quite a considerable debt by taking out payday loans, credit cards and overdrafts.

      It's all in the past and paid paid off after I set up a Debt Management Plan with Stepchange a Debt Management Charity (who were absolutely brilliant and absolutely free) anyway that's not the point of this topic but again may help someone.

      I recently was advised about a website Debt Camel in which I could complain and get money refunded because people lent me money without doing their proper Affordability checks. The website has advice and guidance step by step about putting in complaints against Payday Loan companies, Credit Card Companies, basically anyone who can give you credit.

      I thought it too good to be true but after reading many peoples comments on it, there are some amazing success stories with people getting upwards of £20,000 refunded, so I gave it a go.

      After going back on my bank statements and emails I gathered up all the payday loan companies I ever used and fired them off an email complaining, 13 different companies and countless loans. Couldn't believe there was that many.

      Anyway, what hapens is they respond to your email either upholding your complaint and making you an offer or telling you to piss off.

      I've had 12 responses with only 2 offers, the rest I was told I'm pissing against the wind basically. I accepted one of the offers which was about £350.00 and rejected another with only £100.00.

      If they reject your complaint what you do is send it off to the Financial Ombudsman to investigate for you and it seems to be more often than not you get a result.

      I've only started the process at the end of November and have sent 11 complaints to the Financial Ombudsman to investigate for me. It is a slow process and you need to be patient but so far I'm £350.00 up with hopefully quite a bit more to come.

      Just a bit of an update.

      All my complaints have been referred to the financial ombudsman now so it's just a waiting game now.

      Just off the phone with them and have got another offer of £68.28 from one of the companies and I've accepted.

      So there's over £400.00 back. 2 down 11 to go.

      A further update.

      Just got an offer back from Wonga and they've offered me about £750.00

      I worked out the total interest I paid with them and it's around £1,000.00. I feel that is a fair enough offer so I've accepted, rather than sit and wait months and months for the possibility of not getting much more.

      About £1,150.00 back in total now. 3 down 10 to go.

      Another update, even though there's not too many folk taking an interest.

      All my remaining cases are with the Financial Ombudsman. It's a 2 stage process, firstly an adjudicator looks through your case and comes to a decision, sends it to you and the company, if either party doesn't agree it's escalated to the Ombudsman who will then make a decision and it's legally binding.

      Anyway, an adjudicator was looking through my complaint against Payday UK. I had 4 loans with this crowd and my adjudicator has ruled that all 4 loans were unaffordable and Payday UK should refund all interest and charges on these loans plus 8 statuatory interest.

      I expect Payday UK to reject this and it drag out for months by having an Ombudsman make the final ruling on it, but an Ombudsman never usually rules less than the Adjudicator so I'm happy to wait.

      By my calculations it's about £1000.00 so it'll be worth the wait.

      So over £2,000 back. 4 down 9 to go.

      It's really easy and although a little time consuming to start with, well worth the wait.

      Another adjudicator has made a decision on another one of my complaints.

      They ruled that out of 3 loans I had with them the last one shouldn't have been given to me, so all interest and charges refunded to me and 8% statutory interest.

      Works out about £200.00.

      Brilliant thread this, mate. I'm all for people empowering themselves and improving their situation.

      I've only delves into the PP I thing personally but I've helped a lot of people sort their debts out at work.

      Always worth looking into what you can get back. This industry was out of control a few years ago.

      Do bear in mind that the law has now changed and that some loans will already have been through a redress process under FCA regulations before being sold on to third parties.

      Yeah mate just thought I'd bring it to people's attention. I know I wouldn't have had a clue about it until someone mentioned it to me.

      It made my life hell when I was taking the loans out, completely spiralled out of control, so if I can help at least one person try get some sort of money back then I'll be happy.

      Might have to ask you a question about the PPI, a friend of mine was asking to give him a hand filling in some forms for it, but I haven't the first clue.

      Got another decision back from an adjudicator yesterday and could be about another £7-800. But apparently this company (Lending Stream) are awful to deal with and may just ignore this and it'll have to go to the Ombudsman, so possibly a  3-6 month wait. But I'll get it eventually and thankfully I'm not in the state that I need it now, so I can stick it out.

      Got another couple back from the Adjudicator's at the Ombudsman ruling in my favour so all being well this should be about £4,500 back altogether and still a couple to go.

      Things are starting to move a bit faster thankfully.

      Things starting to slow down, even thought he Adjudicators at the Financial Ombudsman has decided the above companies have to pay me, they seem to be disagreeing with their findings so now an actual Ombudsman has to look into.

      99% of the time the Ombudsman agrees with the Adjudicator so it just seems they are using delaying tactics. Bit annoying but the fuckers get charged £550.00 for each case that gets taken to an Ombudsman so if it means delaying me getting my money, I'm glad they're getting hit for £550.00 as well.

      The Ombudsman overruled the Adjudicator and decided in my favour. An ombudsman decision is legally binging so I was over the moon.

      I was expecting about £200 back from this one, but just got an email from Pounds to pocket today saying they have processed my refund for £1058.00!!!!

      Only a couple left to go, but I think I've done alright so far out of it.

      Congrats mate. Did they provide grounds for their decision? I'd be curious to know what they said and how the redress compares to the original loan amount etc.

      Yeah the Adjudicator basically said that Pounds to Pocket done adequate checks on my finances and credit check etc.

      I replied telling them what my disposable income was and that I had defaults on my credit file from payday loans etc. But he was still satisfied they had done enough so I escalated it to an Ombudsman.

      Hi I'm in a similar situation also and have started a similar process to you with a bit of success. Just needed a bit of advice, some of my PDL's have gone to debt collectors.   However I have written to the Payday Loan companies direct as advised, did you notify the Debt Collectors and Stepchange also as I'm nervous this might spoil my DMP and the debt collectors might escalate if they find out what I'm doing?

      Thankfully none of mine went as far as the Debt Collectors.

      I wouldn't think you have to advise the debt collectors or stepchange to be honest. Your complaint is against the PDL companies irresponibly lending to you no and one else.
