      Plumber wins workers' rights battle against Pimlico Plumbers

      A plumber has won a legal battle for working rights in a Supreme Court ruling expected to have huge ramifications for freelance workers.

      Gary Smith had worked solely for Pimlico Plumbers for six years.

      Despite being VAT-registered and paying self-employed tax, he was entitled to workers' rights, the court ruled.

      The ruling will be closely read by others with similar disputes, many of whom work for firms in the so-called gig economy.

      An employment tribunal was "entitled to conclude" that Mr Smith was a worker, the court ruled.

      As a worker Mr Smith would be entitled to employment rights, such as holiday and sick pay.

      Tim Goodwin of law firm Winckworth Sherwood cautioned that the ruling may not apply to other complaints.

      "Even with a high level decision like this, to a degree the issue of employment status in the gig economy is up in the air.

      "The government is consulting on this issue, and may bring forward legislation. So it's quite possible that Parliament may overrule this decision within the next few months or years."

      And Alan Lewis, employment partner at law firm Irwin Mitchell said the decision was not a "game changer" and that cases would continue to be argued on their specific facts and, for businesses that rely on self employed contracts, that means further uncertainty.

      "This decision is not necessarily a win for 'gig economy' workers seeking to challenge their employment status."

      "Pimlico's plumbers do not operate a gig model and the implications for Uber, City Sprint, Deliveroo etc may be limited, although the publicity around this case may encourage other 'self employed' contractors to challenge their legal status," added Mr Lewis.

      The Supreme Court ruling means that an employment tribunal can now proceed to examine Mr Smith's action against Pimlico Plumbers as a worker, including a claim that he was unfairly dismissed.

      Pimlico Plumbers chief executive Charlie Mullins said he was "disgusted by the approach taken to this case by the highest court in the United Kingdom".

      "This was a poor decision that will potentially leave thousands of companies, employing millions of contractors, wondering if one day soon they will get nasty surprise from a former contractor demanding more money, despite having been paid in full years ago.

      "It can only lead to a tsunami of claims," he added.

      TUC General Secretary Frances O'Grady said the case had exposed "how widely sham self-employment has spread".

      Ms O'Grady said the TUC wanted the government to act quickly to "crack down on bogus self-employment" .

      At the moment it is up to an individual to prove that they are employed and entitled to workers' rights.

      The TUC wants the "burden of proof" to be reversed so workers benefit from rights "unless the employer can show they are genuinely self-employed".

      "It's time to end the Wild West in the gig economy," said Ms O'Grady.

      In February the government promised to overhaul employment rights to improve conditions for millions of workers, including those in the gig economy.

      The proposed changes include stricter enforcement of holiday and sick pay rights, and higher fines for firms that breach contracts or mistreat staff.

      It is a response to last year's Taylor Review into working practices, which concluded that all work in the UK's economy should be "fair and decent" and that people who work for platform-based companies, such as Deliveroo and Uber should be classed as dependent contractors.

      Mr Smith, from Kent, began his battle with Pimlico Plumbers when he wanted to reduce his hours following a heart attack in 2010.

      He wanted to cut the five-day week, which he had been signed up to work with the firm, to three.

      However, the firm refused and took away his branded van, which he had hired. He claims he was dismissed.

      FBI agent who allegedly shot man while dancing charged with second degree assault

      Officials say they are waiting further toxicology results, and that further charges are possible

      An FBI agent who allegedly dropped his gun during a backflip and accidentally shot a man at a Denver night club has been charged with second-degree assault, according to authorities.

      The 29-year-old agent, Chase Bishop, is scheduled to appear in court on Wednesday, and has been booked in the city’s downtown detention centre.

      Mr Bishop may face further charges, the Denver District Attorney’s office said, pending results of a blood test to determine his blood alcohol content (BAC).

      “We are filing this charge now rather than waiting until the BAC report is received, which we understand could take another week, because sufficient evidence has been presented to file it,” District Attorney Beth McCann said in a press release.

      The charges stem from an incident in the early hours of June 1, when Mr Bishop was dancing at the club Mile High Spirits. A video of the incident allegedly shows Mr Bishop dancing with a circle of people around him, before he does a backflip.

      In the course of the backflip, Mr Bishop’s gun allegedly fell out out of his waistband. While attempting to pick up the gun, the gun is seen in the video misfiring. One man was shot in the leg, and survived, but his lawyer has told local media that he suffered serious wounds.

      Mr Bishop then allegedly put the gun into his waistband, and walks out of the camera frame in the video.

      Following the incident, Mr Bishop was not immediately arrested, and was instead released to an FBI supervisor.

      He appeared in court Tuesday on the second-degree assault charges, and the Denver DA says that he turned himself in voluntarily.

      The FBI, citing an ongoing investigation, could not confirm to The Independent whether Mr Bishop has received any disciplinary action following the alleged shooting incident.

      “In order to preserve the integrity of the ongoing investigation, we are unable to comment regarding this matter,” an FBI spokesperson said in an email. “The FBI will continue to fully cooperate with the Denver Police Department and the Denver District Attorney's Office as this matter proceeds through the judicial process.”

      It is not clear whether Mr Bishop was drinking at the time of the alleged incident, but Colorado law prohibits individuals from carrying a firearm while under the influence of alcohol.

      US jogger who dumped homeless man's belongings arrested

      A California jogger filmed dumping a homeless man's belongings in a lake is accused of stealing a bystander's phone as he recorded him a day later.

      Oakland city police arrested Henry Sintay, 30, on Monday on suspicion of robbery after he was apparently filmed in a fracas at the same location.

      Onlooker Matt Nelson shared the video on Facebook and said Mr Sintay had taken his phone during a tussle.

      Mr Sintay has not been charged over removing the homeless man's camp.

      The original video went viral in the US, provoking a debate about gentrification and race.

      Mr Sintay is white and the homeless man - who was not present in either video - is a black man, Greg Markson, reports the East Bay Times.

      Mr Nelson filmed someone alleged to be Mr Sintay last Saturday retrieving some of the homeless man's belongings from the lakeside.

      During the footage, Mr Nelson asks the man if he is the jogger who was caught on film a day earlier after throwing the possessions in the water.

      The man, who introduces himself as Henry, denies having thrown any of the homeless man's items in the lake.

      When Mr Nelson continues to question him while filming, Mr Sintay grabs his phone.   

      The rest of the video is jerky footage of an altercation during which Mr Nelson screams: "I'm being attacked here!"

      On Facebook, Mr Nelson claims he suffered a "mild concussion, some cuts and bruises and many sore and strained muscles" from the encounter.

      Mr Sintay now faces a second-degree robbery charge.

      The San Francisco Chronicle reported that Mr Sintay was being held at the Santa Rita jail and was due to appear in court on Wednesday.

      Absolutely devastating images of the Glasgow School of Art being absolutely gutted by fire. It doesn't look like it can be saved. And really sad for the ABC music venue next door where the fire spread to causing the roof to collapse. I remember seeing a Johnny Marr gig there a few years back whilst being absolutely wasted - absolutely riotous night it was and what a venue for it.

      Absolutely devastating images of the Glasgow School of Art being absolutely gutted by fire. It doesn't look like it can be saved.       200 march in Orgreave probe demo

      Marchers on Saturday issued new calls for a public enquiry into police action during the so called battle of Orgreave during the 1984 miners strike.
      200 attended a rally to mark the anniversary of bloody clashes between thousands of miners and a force of police, security services and the army.
      Mounted officers were filmed clubbing and charging striking miners outside the coking plant in S.Yorkshire.

      Some of the 95 pitmen arrested were at the demonstration and marched past the site of the plant on Saturday, it is now a housing estate.
      Labour leader Jeremy Corbyn sent this message ''The brutality of Orgreave will not be forgotten, a Labour government will hold an enquiry so the truth and justice will come out''.

      Lord Sugar has been criticised for an "unhelpful and ignorant" tweet comparing Senegal's World Cup team to sellers on the "beach in Marbella".

      A picture of the team was posted next to pictures of sunglasses and handbags.

      Lord Sugar, 71, later deleted the post and apologised, saying "my attempt at humour has backfired".

      The British billionaire, who appears on the BBC's The Apprentice, said he "misjudged" the tweet and it was not "intended to cause offence".

      The tweet prompted hundreds of critical responses, including from Twitter users accusing him of racism.

      "I misjudged [my] earlier tweet," he posted later. "It was in no way intended to cause offence, and clearly my attempt at humour has backfired. I have deleted the tweet and am very sorry."

      Earlier the former Tottenham chairman had said his "funny tweet" had been "interpreted in the wrong way as offensive by a few people".

      He added: "Frankly I can't see that, I think it's funny. But I will pull it down if you insist."

      "This lazy, stereotypical and bigoted kind of attitude belongs to a bygone era," educational charity Show Racism the Red Card told BBC Sport.

      "The World Cup is a celebration of different cultures and brings people together from across the globe.

      "Lord Sugar's unhelpful and ignorant comments go very much against the spirit of this unique occasion and are probably best kept to himself."

      Piara Powar, executive director of anti-racism group Fare (Football Against Racism in Europe), said Lord Sugar's "stereotyping of a whole race" was "disgraceful and damaging".

      "Alan Sugar has deliberately and with racist intent sought to demean a World Cup football team," Powar said.

      The BBC said in a statement: "Lord Sugar has acknowledged this was a seriously misjudged tweet, and he's in no doubt about our view on this. It's right he's apologised unreservedly."

      Senegal's team includes a number of Premier League stars including Liverpool's Sadio Mane and Everton's Idrissa Gueye.

      They beat Poland 2-1 in their World Cup opener on Tuesday.

      Anti-racism body Kick It Out declined to comment when contacted by BBC Sport.

      My Mum in Law is 93 has a lifeline pendant in case of a fall. We have just found out that Vauxhall Lifeline went into administration back in March and the staff haven't been paid but continued to work for fear their customers would be left without care.
      They have now been taken over but lost two months pay, pay I would suggest at the lower end of the scale. Not sure how the company went bust but what fantastic people they had working for them many of whom had worked for over 20 years its a good job most people are not just motivated by money because how many of us would work for two months without pay. Met a lot of people in the Care sector when my Mum was poorly and its a pity salaries aren't reflective of commitment.
