Chelsea's Jose Mourinho to be the subject of individual legal claim from former club doctor Eva Carneiro

Jose Mourinho is to be the subject of an individual legal claim from former Chelsea team doctor Eva Carneiro in addition to the action she is bringing against the club for constructive dismissal, it can be revealed.

Press Association Sport understands that legal papers will be served on Mourinho this week as part of separate but connected claims against him and against the club.

It means the Portuguese manager will have to appear in person at an employment tribunal unless the case is settled out of court beforehand. Under employment law, an individual can be personally liable for damages if victimisation or discrimination can be proved.

The claim against Mourinho will be on the basis that he was instrumental in the actions against Carneiro in having her dropped from first-team duties and effectively demoted.

The latest development will heap even more pressure on the 52-year-old who has seen his side lose six out of 11 matches in the Premier League so far to leave the reigning champions in 15th spot in the table.

The controversy over Carneiro goes back to August 8, the opening day of the season, when Mourinho criticised her and head physio Jon Fearn for going on to the pitch to treat Eden Hazard after being called on by referee Michael Oliver. The action meant that Chelsea were temporarily down to nine men against Swansea, and afterwards Mourinho called Carneiro and Fearn "impulsive and naive".

Carneiro did not appear on the bench again for first-team duties and is now seeking a claim for constructive dismissal after parting company with the club.

The doctor's lawyers said neither she nor they could comment as the case is sub judice. Chelsea did not respond when asked if they wished to comment.

Mourinho was cleared of using discriminatory language towards her following an investigation by the Football Association, which caused further controversy after Carneiro revealed she had not been spoken to personally during the investigation, nor asked to provide any statement.

The FA's chief executive Martin Glenn and head of governance Darren Bailey are to be quizzed about the handling of the case by the governing body's Inclusion Advisory Board later this month.

The IAB's chair Heather Rabbatts is under investigation by the FA following her comments criticising officials for not speaking to Carneiro in person during the Mourinho investigation.

It has been reported that Sky Bet Championship club Charlton could be preparing an offer to Carneiro to work for them, but no one at the club has yet been available for comment.

just when you think it can't get any better this turns up and this time its personal. When you have witnessed a low life succeed on the backs of others its really refreshing to see the time when all the past wrong doings all come together.
This could actually be the nail in the Coffin for him.

Top London lawyer's anti-Liverpool rant after Chelsea loss: 'Crawl back to your horrible Merseyside home'
Clive O’Connell, a partner at law firm Goldberg Segalla, was filmed referring to fans as 'Scouse scum' and 'nasty horrible people' before venting his anger on Twitter.

A top London lawyer has been filmed in an extraordinary rant about Liverpool supporters after their side beat Chelsea 3-1 at the weekend.

Clive O’Connell, a partner at law firm Goldberg Segalla, was being interviewed by Neek Sports outside Stamford Bridge when he brazenly referred to the fans as "Scouse scum" and "nasty, horrible people."

After the match, the avid Jose Mourinho supporter also took his anger to Twitter, replying to one fan: "Crawl back to your horrible Merseyside home."

When asked by football website Neek Sports about Mourinho's position in the footage, he started slow but built to boiling point outside Stamford Bridge.

There is no-one better than Mourinho," he said. "Can you name a better manager out there, available or not?"

"Ancelotti's not better than Mourinho and he's older, Mourinho's a better long-term prospect," he continued.

"Why do you think the Scouse scum are singing 'you're getting sacked in the morning' when we sang to Benitez 'we want you to stay' when he was managing Liverpool?

"Even those nasty, horrible people know that Mourinho is the best manager in the world - they're scared".

He goes on to blame a conspiracy against Chelsea by the referee and the FA for the defeat in the interview, which was posted on Facebook and prompted a divided response on Twitter.

Mr O'Connell later made a public apology in an interview with the Evening Standard before changing his Twitter account's settings to private.

According to his profile on the Goldberg Segalla website, Mr O'Connell is 'recognised as one of the world’s leading insurance and reinsurance legal professionals'.

Last year he was named United Kingdom Insurance and Reinsurance Lawyer of the Year, by Lawyer Monthly.

Mr O'Connell told the Evening Standard: "I was very disappointed in the aftermath of Saturday’s game.

“I let my emotions get the better of me. I clearly regret this and any offence that I may have caused by my hot headed and regrettable reaction, which was inappropriate whether or not caught on camera.”

The paper also reported that Daniel W. Gerber, chair of Goldberg Segalla’s Global Insurance Services Group, said the firm was "surprised" at the remarks.
